CyRisk Privacy Policy

his Privacy Policy describes what personal information we collect, how we collect and use your personal information, who we disclose it to and why, the measures we take to protect your personal information, and the choices you may have regarding our use of your personal information. It covers our CyRisk website(s) and mobile apps and services where this Privacy Policy is posted (“Site”). 

All capitalized terms not otherwise defined in this Privacy Policy will have the meaning set forth in our Terms of Use. 

CyRisk respects and will protect your privacy. CyRisk uses industry standard security practices including encryption technology, to protect against the loss, misuse, and alteration of data contained in our database. CyRisk is concerned about the security and accuracy of the personal information you provide to us. Information provided to us through this website will not be sold, rented, or leased without your permission. 

This Privacy Policy explains the information CyRisk gathers on the web site [CyRisk.com] that CyRisk owns (the “Site”), as well as the ways in which CyRisk processes and, sometimes, shares such information and how you can correct or change that information. The Site may also include versions designed for browsing on mobile devices and the information gathered by CyRisk from such devices is governed by this Privacy Policy as well. 

What is not covered in this Privacy Policy? 

Except where otherwise expressly indicated herein or on the Site, this Privacy Policy applies only to information collected on the Site and does not apply to information collected outside of the Site. Before using or submitting information to the Site, please review this Privacy Policy carefully. 

Certain areas of the Site contain information intended only for users who create an account, join or otherwise register to use a specific area of the Site (“Registered Users”) and CyRisk reserves the right to limit these areas to Registered Users. This Privacy Policy addresses CyRisk’s privacy practices relating to general use of the Site, as well as the use of the Site by Registered Users. 

This Privacy Policy does not apply to, nor limit, our use or disclosure of non-personal, de-identified or aggregated information (i.e., information which is not relevant to you or able to identify you) that we may collect from you via your use of the Site. 

  • Non-Personal Information. This is information that is un-identified and non-identifiable, which is generated by a user’s activity. Such non-personal information may include the following information – browser type, web pages you visit, time spent on those pages, access times and dates. 
  • Information Collected Automatically by CyRisk. CyRisk may receive and store certain types of information whenever you interact with CyRisk through the Site. We automatically receive and record your browser information, operating system information
    • and the page you requested, the time and date of your visit to our website, and your domain name. This information is anonymous session-information and will not be stored in a manner that is personally identifiable to you. 
    • Aggregate Information. In connection with your visit to the Site, CyRisk may automatically collect usage information, such as the numbers and frequency of users and their characteristics and information about similar groups of users, users that live in a particular geographical area. This data is only used in the aggregate as a statistical measure and not in a manner that would identify you personally. Aggregate information generally is collected through the use of cookies and Web Beacons as discussed below. 

     

    What Personal Information Do We Collect? 

    We may collect or receive the categories of personal information listed below, which may depend on the products or services you may use, as well as your device and account settings. Not all categories of personal information will be collected or received about every individual. 

    • Basic Personal Identifiers, such as name, job title, company name, and contact information (telephone and/or fax number, physical address, email address), government-issued identifiers (e.g., national identification numbers, driver’s license numbers), and signatures. 
    • Device and Online Identifiers, such as account login information, MAC address, IP address, cookie IDs, mobile ad IDs, and social media information.  
    • Internet and Other Network Activity Information, such as information about your browsing or search activity as well as your interactions with our websites, mobile applications, emails, or advertisements such as keystroke patterns (these tell us if it’s you who is interacting with us, or a bot). 
    • Commercial Information, such as industry category, company size, and, where applicable, purchase and transaction history information (including products or services you have purchased). 
    • Communications: Communication details (such as the content of emails, text messages, or other communications), call logs, and calendar information, where CyRisk is a party to the exchange. 
    • Demographic Information, such as age, gender, citizenship, ethnicity, date of birth, family or marital status, household income, education, professional and employment information, family health, number of children, number of cars owned, and software or virtual assets owned. 
    • Financial Information, such as credit or debit card numbers, and financial account numbers. 
    • Geolocation: Data about the location of your device, which may be imprecise (i.e., inferred from your device’s IP address). If you provide your consent, this data may be precise. For more information about precise geolocation, see the How Do We Collect Personal Information? > Collected Through Automated Means section below. 
    • Sensory Information: Audio, visual information, and other sensory information such as photographs and audio and video recordings. 
    • Background Information: Background and criminal information, such as background checks and criminal convictions. 
    • Inferences: Individual preferences and characteristics, such as inferences drawn from and related to web activity patterns and behaviors, intelligence, and aptitudes. 

    While CyRisk collects and processes personal information as described in this privacy Policy, the Service is not intended to be used for the processing or storage of sensitive or special categories of personal information by users. 

    How Do We Use Personal Information? 

    We use personal information to provide you with products and services and to operate and improve our business. For example, we use it for: 

    • Performing services, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing analytics services, providing storage, or providing similar services; 
    • Performing and providing advertising and marketing services, including targeted advertising; 
    • To conduct auditing and monitoring of transactions and engagement, including auditing related to counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance; 
    • Short-term, transient use, such as non-personalized advertising shown as part of your current interaction with us; 
    • Helping to ensure security and integrity and prevent fraud; 
    • Undertaking activities to verify or maintain the quality or safety of our services or devices and to improve, upgrade, or enhance them; 
    • Debugging to identify and repair errors; 
    • Conducting business analysis, such as analytics, projections, identifying areas for operational improvement; 
    • Conducting research and development, including undertaking internal research for technological development and demonstration; and 
    • Fulfilling our legal functions or obligations. 

    To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law. 

    How Do We Collect Personal Information? 

    We may obtain and combine personal information from different sources, collected online and offline, including information from third-party sources across different types of technology and devices. 

    Provided Directly by You 

    When you visit us online, you may share different types of personal information with us when you engage in the activities below: 

    • Create an account on one of our websites or mobile services; 
    • Participate in our programs, such as opting into special offers; 
    • Request customer service or contact us; 
    • Interact with various types of technologies, applications and features; 
    • Post a rating, review or other user-generated content on one of our websites or mobile services, or post a review or comment on one of our social media pages; 
    • Post information to the secure portion of the Site that is made available to Registered Users only. 

    Collected Through Automated Means 

    We may obtain personal information about you such as device and online identifiers and internet or other network activity information via automated means through your use of technology, such as when you visit our websites or use our mobile applications or services, or click on advertisements or links in emails you receive from us. 

    Also, depending on your device’s settings, we may collect precise geolocation information. You can control our ability to do this by adjusting the location-sharing settings on your mobile device at any time. You also may adjust your mobile device’s Bluetooth settings to disable the sharing of Bluetooth location-related data. 

    Obtained from Other Companies within Our Corporate Family 

    We may obtain your personal information from another company within our corporate family, such as 4A Security & Compliance. 

    Obtained from External Third-Party Sources 

    We may obtain personal information about you from other sources to help us correct or supplement our records, improve the quality or personalization of our services, increase the appeal and relevance of advertising, and to prevent or detect fraud. We also may obtain device and browsing information, from third parties for marketing purposes. 

    Collected from Another Solution or Asset 

    For example,when you speak to customer service, we collect your personal information using call recording technology in accordance with applicable lawV. 

     

    Cookies and Similar Technologies 

    We use Cookies and similar tracking technologies to track the activity on the Site and store certain information. Tracking technologies used are beacons, tags, and scripts to collect and track information and to improve and analyze the Site. The technologies we use may include the following: 

    (i) Cookies. CyRisk uses “cookies” to help you access and navigate the Site more efficiently and to statistically monitor how many people are using the Site. A “cookie” is a small text file stored on your hard drive which stores information about your interactions with the CyRisk website. Cookies help us deliver customized information to you. If you become a Registered User, CyRisk may use cookies to store your e-mail address, user name, and preferences so that CyRisk can identify you when you return to the Site, track your use of the Site and customize the Site for you. You may set your browser to notify you of or decline the receipt of cookies. Certain features of the Site may not, however, function properly or be available if your browser is configured to disable cookies. 

    CyRisk uses both “session” and “persistent” cookies on the Site. Session cookies are temporary bits of information that are erased once you exit your web browser or turn off your computer. Persistent cookies are more permanent bits of information that are placed on the hard drive of your computer and stay there unless you delete the cookie. Persistent cookies store information on your computer for a number of reasons, such as retrieving certain information you have previously provided (i.e., username and password), helping to determine what areas of the Site you find most valuable and customizing the Site based on your preferences on an ongoing basis. Cookies also help us detect and resolve website problems, assist with customer support and gather statistical information about how consumers use our website and services so that we may make further improvements. Many companies offer programs that help you to visit websites anonymously. While CyRisk will not be able to provide you with a personalized experience if CyRisk cannot recognize you, CyRisk wants you to be aware that these programs are available. 

    We may allow service providers and other third parties to use cookies and similar technologies to track your browsing activity over time and across the Service and third-party websites. Most browsers allow you to delete or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Sites may not work properly. Similarly, your browser settings may allow you to clear your browser web storage. 

    CyRisk uses ad trackers from Alphabet, Inc. and HubSpot, Inc., as well as Google Analytics remarketing tags. CyRisk also uses keystroke logging, but only for the purposes of providing auto-complete functionality within web forms on the Site for Registered Users (and to verify that a human, not a bot, is interacting with our Site.) 

    Cookies can be "Persistent" or "Session" Cookies. Persistent Cookies remain on your personal computer or mobile device when you go offline, while Session Cookies are deleted as soon as you close your web browser. We use both Session and Persistent Cookies for the purposes set out below: 

     

    (ii) Web Beacons 

    Certain sections of the Site and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity). 

     

    To Whom Do We Disclose Personal Information & Why? 

    We may share the categories of personal information described above with certain categories of third parties, as described below. 

    Within Our Corporate Family of Companies 

    We may disclose your personal information to other companies within our corporate family (namely, 4A Security & Compliance) for them to use in ways that are consistent with this Privacy Policy. 

    Other Companies  

    We may disclose information to the entities listed below, for the reasons described. In circumstances other than those described below, in accordance with applicable law, we will provide specific notice or ask for your affirmative consent. 

    Vendors for Business Operations: We disclose personal information about you to vendors to perform services on our behalf. These vendors include without limitation, billing and refund vendors, payment card processors, and companies that help us improve our products and services. 

    Advertising, Marketing, and Other Related Technology Partners: We work with various advertising, marketing, and other related technology partners so we can both market our products to you and provide advertising services to other companies. 

    • Advertisers. These are companies that place ads through our advertising services. Advertisers may use pixels or cookies in their ads that collect information from/about you to help them understand how you respond to their ads.  
    • Publishers. These are companies that operate the websites that you visit (e.g. an online newspaper or an entertainment website). We share personal information with publishers to help us serve ads to you on their websites and to help us understand how those ads perform.  
    • Social Media Platforms. We share personal information with social media platforms that help us serve ads to you on those platforms. 
    • Advertising Technology Providers. We work with companies that use cookies, pixels, beacons and similar technologies to tailor the ads you see using information collected about you over time on our Sites, and across other participating websites and mobile services. Advertising Technology Providers include ad servers, advertising agencies, technology vendors that support media buying and selling, and research firms. For more information about your choices related to interest-based advertising, see Interest-Based Advertising Preferences in the How Can You Set Your Preferences? section below. 
    • Data Technology Vendors. We work with technology providers that help us manage and automate the use of the data we collect (including personal information). These companies include, for example, technology providers that help us automate our advertising services, and identity management companies. 
    • Measurement and Analytics Vendors. These vendors include, for example, companies that provide aggregate reporting on our website performance, and the effectiveness of our advertising campaigns and services.     Law Enforcement, Courts, and Other Legal or Governmental Bodies 

    We may disclose your personal information when required by law or legal process, or when we believe doing so will help to protect the safety, property, or rights of individuals or CyRisk. Examples include: 

    • Protecting the health or safety of individuals; 
    • Identifying and addressing fraud or financial risk; 
    • Responding to a request from law enforcement, search warrant, or other valid legal inquiry; and/or 
    • Responding to a court or other investigative body in the case of an alleged breach of an agreement or violation of law. 

    Business Transfers 

    If we plan to merge, sell, or reorganize our business, we may disclose your personal information, along with personal information of other CyRisk customers as part of the business arrangement. (This may also include transfers of personal information made as a part of insolvency or bankruptcy proceedings). We will use reasonable measures to help ensure your information is handled in accordance with this Privacy Policy. 

    How Can You Set Your Preferences? 

    Marketing 

    For marketing communications, we use an: 

    • Opt-in standard for automated phone and text messages, and for disclosing personal information with companies outside of our corporate family of companies to promote their products and services through direct marketing. Opt-in means we will only conduct the activity with your consent.  
    • Opt-out standard for email, mobile service (in-app) notifications, and postal mail. 

    You may withdraw your consent if you would like to stop receiving marketing communications. Please communicate your marketing communications requests directly to us or through a third party authorized to act on your behalf by: 

    • Visiting the Communication Preferences & Alerts page to adjust your preferences for marketing communications. 
    • Using the Contact Us section below, providing the types of communications you would like to receive or not receive, and your contact information. 

    For email requests, it may take up to x days for us to process your requests. For requests related to telephone calls, text messages, mobile service notifications, and disclosing information with your consent, it may take up to 30 days. 

    Regardless of your marketing communication preferences, we may still contact you for transactional or informational purposes, such as customer service, reminder or service notices, recalls, or information regarding your account. 

    Interest-Based Advertising 

    Interest-based ads are optimized for effectiveness based on inferences about you. For more information about interest-based advertising, see the Advertising, Marketing, and Other Related Technology Partners section above. To adjust your preferences for interest-based advertising, follow the instructions below: 

    • Opt out of CyRisk interest-based ads through your CyRisk.com account. When you browse CyRisk.com via your web browser or browse sites where CyRisk has ad space, you may see advertisements that are tailored to your interests. You can opt out of receiving these ads through our advertising settings. If you opt out, you will still see advertisements on CyRisk.com, but they will not be relevant to your interests. 
    • Opt out of interest-based ads on your mobile device. Mobile devices offer options for opting in or out of interest-based advertising. Please refer to your device settings and instructions for additional information. 
    • Opt out of interest-based ads through advertising groups. You can opt out of interest-based advertising by advertisers that are part of the National Advertising Initiative or who follow the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising by clicking the links provided. 

    To successfully opt out of interest-based advertising, you must have cookies enabled in your web browser (see your browser’s instructions for information on cookies and how to enable them). Opting out only applies to your current web browser on your current computer. If you use multiple computers or multiple web browsers, you must opt out on each one. If you delete your browser’s saved cookies, you will need to opt out again. If you have opted out of receiving interest-based ads on CyRisk.com previously and would like to opt out of interest-based ads that are provided by CyRisk on sites outside of CyRisk, please resubmit an opt-out request on the Ad Preferences page. 

    Our Site is designed to respond to the Global Privacy Control signal. It will not respond to other types of “Do Not Track” (DNT) signals. 

    How Can You Access and Update Your Personal Information? 

    You can access or update your personal information as described below. 

    • Enter and update your own contact information and payment information, as well as contact information for your delivery recipients, by logging into your CyRisk account. 
    • To change your personal information as it relates to specific services provided by CyRisk business partners or service providers, use the Contact Us section below and we will refer you to the correct partner. 
    • To delete your CyRisk account, use the Contact Us section below. Or, within our mobile apps, visit the “Account” section of the CyRisk app and click the “Request to Delete Account” link. 

    You can also access or update any of the information described in the bullets above by using the Contact Us section below and including, along with your contact details, the information you would like to access or update and any requested changes. Consumers in certain states have additional rights, which are addressed below in the State Privacy Rights section. 

    How Do We Secure Your Personal Information? 

    Whether you are using our websites or mobile services, we use reasonable information security measures, including physical, administrative, and technical safeguards. Learn more about measures you can take to help to protect the security of your personal information. 

    CyRisk maintains a variety of commercially reasonable physical, electronic and procedural safeguards designed to protect your Personally Identifiable Information from unauthorized access and disclosure. We use industry-standard encryption technology when transferring and receiving client information exchanged with our site, as well as internal procedures and strict guidelines to prevent information misuse and data leakage. All information gathered on the site and stored by us is maintained in a secure facility that limits access to authorized personnel only. We restrict access to your personal information to those persons who need to know it for the purpose described in this privacy policy. CyRisk’s website is regularly tested for security vulnerabilities to ensure that all information is secure from unauthorized viewing. We use measures and procedures that substantially reduce the risks of data misuse; however, security risk is inherent in all internet and information technologies and we cannot guarantee that our systems will be absolutely safe. Where we have given you (or where you have chosen) a password that enables you to access certain parts of our Platform, you are responsible for keeping that password confidential. Please do not share your password with anyone. 

    How Long Do We Retain Your Personal Information? 

    We will keep the personal information we collect about you for as long as necessary to carry out the purposes set forth in this Privacy Policy or any other notice provided at the time of data collection, but no longer than as required or permitted under applicable law or internal CyRisk policy. We dispose of the personal information we collect in accordance with CyRisk’s retention policies and procedures. 

    We will retain your personal information for as long as necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the data, the availability of automated controls that enable users to delete data, and our legal or contractual obligations. For example, we may retain your personal data for longer periods, where necessary, subject to applicable law, for security purposes. 

    We will delete or anonymize personal data when it is no longer necessary for processing purposes or when there is no longer a legal basis for processing the personal data, as set out in Section TBD. The duration of this period will vary, depending on the type of personal data concerned and the applicable legal requirements and data retention periods. 

     

    How Does CyRisk Protect the Privacy of Children Online? 

    Our Site is designed for a general audience and is not directed to children under the age of 13. We do not knowingly collect personal information from children under the age of 13 online. CyRisk requires that only persons 13 years of age or older may use any of the Site. By using the Site, you hereby represent that you are at least 13 years old. If CyRisk becomes aware that it has inadvertently received personal information from a visitor under the age of 13 on the Site, then CyRisk will delete the information from its records. 

    Please contact us if you have concerns regarding the potential collection of your child’s information. 

    Links to Third-Party Services and Features 

    We want to improve your online experience and make it easier to discover new products and services through our Sites. We may provide you with links to other online services (such as websites or social media platforms) and may include third-party features such as apps, tools, widgets, and plug ins. We may not own or control these linked online services or third-party features, and we are not responsible for the information practices of the third parties that have ownership or control over them. In some cases, these third parties operate independently from us, which means their privacy practices are not covered in this Notice. We recommend that you review their privacy statements to learn about these third parties' privacy practices, including details on the personal information they may collect about you.

    California & Other U.S. State Privacy Rights 

    Under some U.S. state laws, including the California Consumer Privacy Act of 2018 (as amended by the Consumer Privacy Rights Act (CPRA)) (“CCPA”), residents may have a right to: 

    • Access the categories and specific pieces of personal data CyRisk has collected, the categories of sources from which the personal data is collected, the business purpose(s) for collecting the personal data, and the categories of third parties with whom CyRisk has shared personal data, and obtain the personal data in a portable and, to the extent technically feasible, readily usable format; 
    • Delete personal data under certain circumstances; 
    • Correct personal data under certain circumstances; and 
    • Opt out of the “sale” of personal data or “sharing” of personal data for targeted advertising purposes. We do not sell your personal data in the conventional sense. However, like many companies, we may use advertising and analytics services that are intended to analyze your interactions with our website or app, based on information obtained from cookies or other trackers, including for delivering advertising to you (such as interest-based, targeted, or cross-context behavioral advertising). You can get more information and opt out of the use of cookies and other trackers on our website by clicking the [insert path here] link, also on our homepage, and setting your preferences. You will need to set your preferences from each device and each web browser from which you wish to opt out. This feature uses a cookie to remember your preference, so if you clear all cookies from your browser, you will need to re-select your preferred settings. California, Colorado, and Connecticut residents may also set the Global Privacy Control (GPC) to opt out of the “sale” or “sharing” of your personal information for targeted advertising for each participating browser system that you use. CyRisk does not have actual knowledge that it “sells” or “shares” the personal information of consumers under 16 years of age. 
    • Appeal a denial of your request. Some states provide additional rights to their residents. If we decline to process your request, you may have the right to appeal our decision. You can do so by replying directly to our denial or emailing privacy@4asecurity.com. 

    CyRisk will not discriminate against you for exercising any of these rights, which is further in line with your rights under state law. 

    Sensitive Information. CyRisk receives information that may be considered sensitive under some state laws, such as certain Account Information (e.g., financial information, log-in information). CyRisk processes sensitive personal information to provide CyRisk products and services, for product research and development, for authentication, integrity, security, and safety reasons, to communicate with you, for legal reasons, and with your consent. CyRisk does not use or disclose sensitive personal information (as defined under CCPA) for purposes of inferring characteristics about a consumer, or in any way that would require CyRisk to provide a right to limit under the CCPA. Under certain laws, residents may also be permitted to opt out of certain profiling relating to automated processing analyzing certain categories of an individual’s information that would produce a legal or similarly significant effect. CyRisk does not engage in this type of profiling of individuals.

    We will acknowledge receipt of your request within 10 business days, and provide a substantive response within 45 calendar days, or inform you of the reason and extension period (up to a total of 90 days) in writing. 

    These rights are not absolute, are subject to exceptions and limitations, and may not be afforded to residents of all states. In certain cases, we may decline requests to exercise these rights where permitted by law. We will need to verify your identity to process your access, deletion, and correction requests and reserve the right to confirm your state residency. To verify your identity, we may require you to log into your existing CyRisk account (if applicable), give a declaration as to your identity under penalty of perjury, and/or provide additional information, such as providing at least two pieces of personal information relating to your account (which will be compared to information we have, such as profile information) or as we otherwise may already have in our possession, such as your email address and phone number. We will verify your consumer request by comparing the information you provide to information already in our possession, and take additional steps to minimize the risk of fraud. You may designate an authorized agent to submit your verified consumer request by providing written permission and verifying your identity, or through proof of power of attorney. 

    California’s Shine the Light Law 

    California Civil Code Section 1798.83, also known as the “Shine The Light Law”, permits California residents to annually request information regarding the disclosure of your Personal Information (if any) to third parties for the third parties’ direct marketing purposes in the preceding calendar year. We do not share Personal Information with third parties for the third parties’ direct marketing purposes. 

     

    How Will I Know if this Privacy Policy Changes? 

    At any time without prior notice, we may in our sole discretion update this Privacy Policy to reflect changes in our practices for a variety of reasons, including to comply with new laws and regulations, to cover new features and functionality, and/or to increase transparency. When we post changes to this Privacy Policy, we will revise the “Last Updated” date at the top of this page. We encourage you to bookmark this Privacy Policy and to periodically review it, keeping yourself informed  of changes to it or any of CyRisk’s other policies. Any changes to this Privacy Policy will become effective upon our posting of the updated policy. Your continued use of the Site after the posting of any modified Privacy Policy constitutes your acceptance of the terms of this Privacy Policy then in effect. 

    Users From Outside the United States 

    By visiting the Site, submitting information or using any of CyRisk’s products or services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and consent to having your data transferred to and processed in the United States. If you do not agree to this Privacy Policy, then please do not use CyRisk’s Site. 

    The Site is controlled and operated by CyRisk from the United States. CyRisk does not represent or warrant that the Site, or any part thereof, is appropriate or available for use in any particular jurisdiction. Those who choose to access the Site do so on their own initiative and at their own risk and are responsible for complying with all local laws, rules, and regulations.
